THESE REFERRAL PROGRAM TERMS AND CONDITIONS (THE “REFERRAL TERMS”) ARE SUBJECT TO THE TERMS OF SERVICE (“TOS”) OF AVENIX SOLUTIONS LLC, DOING BUSINESS AS OPTIONSCANNER (REFERRED TO AS “WE” OR “US” BELOW). Please read these Referral Terms carefully. These Referral Terms incorporate by reference our Terms of Service and Privacy Policy, which may be found at https://optionscanner.ai/terms and https://optionscanner.ai/privacy. By creating an account, connecting a brokerage, purchasing a subscription, or otherwise using the Service or referring us new account holders, you agree to be bound by these Referral Terms and our Terms of Service and Privacy Policy. If you do not agree, do not use the Service or refer us prospective account holders. Optionscanner is a software product. It is not a broker-dealer, investment adviser, or bank. It does not open or custody brokerage accounts, hold customer funds or securities, or provide investment advice. Brokerage accounts and order execution are provided by the brokerage you connect under your own agreement with that brokerage.
We offer a referral program for users of the Service whereby you can refer new users to us and be eligible to receive a referral credit if both you and such referred user create a paid account with us in accordance with the requirements set forth in our TOS and which satisfies the requirements set forth herein (a “Referred Account”). Referred Accounts may not be associated with yourself, an account you control, or a household or business associate acting on your behalf. Additionally, users associated with Referred Accounts must not currently or have previously held an account with the Service.
We have provided you with a personal referral link on the REFER A TRADER card under SETTINGS, then BILLING, in the app (the “Referral Link”). You can share this Referral Link with as many new users as you like. You will only earn a Referral Credit if you create a paid account and the new user qualifies as a Qualifying Referral and creates a Referred Account. You may only share the Referral Link in accordance with applicable law.
For each Referred Account that has ended its free trial, results in the associated account holder becoming a paying subscriber and the first subscription payment for such account is collected (a “Qualifying Account”), and provided that you are a paying subscriber, you will be eligible to receive one (1) referral credit equal in value to one (1) month of your subscription to the Service, up to the standard monthly subscription price published at optionscanner.ai/pricing (a “Referral Credit”). Referral Credits have no cash value, are not transferable, cannot be exchanged for cash or any other consideration, and do not accrue interest. Referral Credits are applied automatically to your next invoice. Referral Credits that remain unapplied when your account is closed are forfeited. If you are not yet a paying subscriber, we will record the Referral Credit as pending and apply it when you complete checkout for your own subscription. For the avoidance of doubt, a sign-up, a completed trial, or a trial cancelled before payment is not a Qualifying Account.
No more than twelve (12) Referral Credits may be earned in any rolling 365-day period. Each Referred Account can produce one (1) Referral Credit only, regardless of later cancellations or re-subscriptions.
In order to earn a Referral Credit, you must be a user of the Service. In order to utilize the Referral Credit, you must be a paying subscriber. If you refer a Qualifying Account during a period where you are not a paying subscriber, you will earn a Referral Credit which will be recorded by us and applied in accordance with the terms set forth herein.
Any refunds, reversals or chargebacks with respect to a Qualifying Account, or if we determine that a Referred Account was obtained through fraud, misrepresentation, automation, or a breach of these Terms or applicable law (a “Clawback”), we may (in our sole discretion), cancel and remove from your account the Referral Credit associated with such Clawback. Any Referral Credit generated through unauthorized performance or trading representations is automatically void and forfeited.
Referral Links may not be shared generally with the public or as unsolicited bulk communication or present it as anything other than a personal referral. You must not make any statement about trading results, returns, or performance in connection with a referral.
We may modify, suspend, or end the Referral Program at any time. Referral Credits already earned under this Section 8 remain valid according to their terms; changes apply to referrals that qualify after the change takes effect.
You are responsible for any tax consequences of Referral Credits you receive.
These Referral Terms are subject to, and incorporate by reference, the Company’s TOS and Privacy Policy by reference. In the event of a conflict between these Referral Terms and the Terms of Service, the Referral Terms shall prevail.
These Referral Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. The governing law and forum provisions in this Section apply only to the extent permitted by applicable law and do not deprive you of any mandatory consumer protection rights of the jurisdiction in which you reside.
